The transaction concerns transfer of land associated with the Skirling Estate, Peebleshire.<br \/>\nThe document is in latin and is confirmed with the unique notary seal of\u00a0Thomas Hardkneys<\/span><\/p>\n<div id=\"attachment_1026\" style=\"width: 310px\" class=\"wp-caption alignright\"><a style=\"color: #000000;\" title=\"Notary Seal 1434\" href=\"http:\/\/harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal.jpg\" target=\"_blank\" rel=\"noopener noreferrer\"><img loading=\"lazy\" decoding=\"async\" aria-describedby=\"caption-attachment-1026\" class=\"  wp-image-1026 size-medium\" title=\"Notary Seal 1434\" src=\"http:\/\/harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal-300x164.jpg\" alt=\"\" width=\"300\" height=\"164\" srcset=\"https:\/\/www.harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal-300x164.jpg 300w, https:\/\/www.harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal-1024x561.jpg 1024w, https:\/\/www.harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal-768x421.jpg 768w, https:\/\/www.harkness.scot\/wp-content\/uploads\/2020\/11\/Notary-1434-Seal.jpg 1426w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><p id=\"caption-attachment-1026\" class=\"wp-caption-text\">Notary Seal of Thomas Hardkneys 1434<\/p><\/div>\n<p><span style=\"color: #000000;\"> It is interesting that the <a style=\"color: #000000;\" title=\"National Archive Online Catalogue\" href=\"http:\/\/catalogue.nrscotland.gov.uk\/nrsonlinecatalogue\/details.aspx?reference=GD89%2f1%2f314&amp;st=1&amp;tc=y&amp;tl=n&amp;tn=n&amp;tp=n&amp;k=&amp;ko=a&amp;r=GD89%2f1%2f314+&amp;ro=s&amp;df=&amp;dt=&amp;di=y\" target=\"_blank\" rel=\"noopener noreferrer\">National Archive<\/a> Record GD89\/1\/314 records in the summary of the document \u201c<b>Thomas Harkness<\/b>\u201d.<\/span><\/p>\n<p><span style=\"color: #000000;\">The following are to be found in the<em> \u2018Calendar of Writs Preserved at Yester House 1166 \u2013 1625\u2019<\/em> <em>(Scottish Records Society. 1930)<\/em>.<\/span><\/p>\n<ul>\n<li><span style=\"color: #000000;\">On 12th April <b>1447<\/b>, <b>John Herknes<\/b>, chaplain at Pebyllis, was a witness to a charter whereby a Scottish noble, Sir David de Haye, donated, \u201cfor the safety of his soul\u201d, one acre of ground to the Vicar of Stobo (Stobo Kirk still exists a few miles from Peebles). <i>(Entry 84).<\/i><\/span><\/li>\n<li><span style=\"color: #000000;\">On 26th November <b>1448<\/b>, <b>Thomas Hardkneis<\/b>, notary, witnessed a charter again involving Sir David Haye. The document was dated at the Castle of Jedburgh in the Scottish Borders, but there are clear connections with Peebles. One of the other witnesses being the <i>\u201cDean of Christianity of Peblis\u201d,<\/i> and David Haye was sheriff of Peebles about this time. <em>(Entry 89)<\/em><\/span><\/li>\n<\/ul>\n<p><span style=\"color: #000000;\">In the records of the \u2018Charters Relating to the Burgh of Peebles\u2019 on the 20th April <b>1448<\/b> <i>\u201cMaster John Wach and <b>Sir Thomas Hardkneis<\/b>, notaries of public\u201d<\/i> witnessed a charter in which Sir John Blounte, Rector of Lyne, gifted a building to the town of Peebles.\u00a0<\/span><\/p>\n<p><span style=\"color: #000000;\">In 15th century Scotland a Notary Public was usually, but not always, a priest of the Roman Catholic Church who was trained in the law. Before a transaction such as transfer of property or land was considered legal it had to be recorded and verified by a Notary who appended his own unique seal, at that time hand drawn, to the document. The seal of Thomas Hardkness which includes a\u00a0representation\u00a0of a cross might suggest that he was a priest.
